Lawsuit Crazy

One of the most ridiculous stories ever to hit the news occurred a few years back when a young man fell decided to break into a school building. While attempting to break through a skylight, he fell and injured himself badly. He sued the school district (maybe there weren’t any safety signs posted around it up on the roof?) and he won. One can only hope that the judge who made that decision did not get re-elected.

Weird lawsuits crop up all the time, and unfortunately New York gets quite a number of them. This one which came to the public’s attention in July 2011 has a lot of people scratching their head in wonder. A woman who was drunk and high on marijuana got into her brother’s vehicle along with two of her children and three of her brother’s children. Her intent was to take them home from a camping trip.

Diane Schuler entered the Taconic State Parkway the wrong direction and managed to drive for 1.7 miles while the oncoming traffic with the right of way swerved to avoid her. Eventually she slammed head-on into a Chevrolet Trailblazer carrying three adult men. Diane and four of the children and the three men were all killed. Her five year old son was injured badly, but survived. It was a horrible accident, and Diane’s body was tested with the results showing that her alcohol content was .19% which is twice the legal driveable limit here in New York and most other states. The autopsy also showed that she had smoked marijuana within fifteen minutes of the accident.

Her husband has now decided to sue the state of New York. He says that the road is not marked clearly enough and that is why his wife made the error which led to the fatalities. Never mind that other people seem to find it marked clearly enough that there aren’t repeated instances of cars entering there. Never mind that she drove quite a ways and still didn’t catch on that she was the only one going that direction. People had to be honking at her like crazy!

Daniel Schuler has also decided to sue his brother-in-law that loaned her the vehicle and let her take his kids.

It must be a terribly grievous situation to lose one’s wife and a child and have another one hospitalized. But not facing up to the truth that her substance abuse led to the accident is not going to bring about any good.
